1. Introduction
These Terms and Conditions ("Agreement") govern the relationship between you ("Client," "you," or "your") and Jenny Gong Realtor ("Agent," "we," "us," or "our") for the provision of real estate services. By engaging our services, you agree to be bound by these terms.

2. Scope of Services
Jenny Gong Realtor provides real estate services including, but not limited to, property listing, property search, negotiation, and transaction management. The scope of services will be defined in the agreement signed between the Client and the Agent.

3. Representation

Buyers: As a buyer’s agent, we will act in your best interests to locate and negotiate the purchase of property. Sellers: As a seller’s agent, we will market and negotiate the sale of your property. Dual Agency: In cases where dual agency is permitted by law, we may represent both buyer and seller with full disclosure and written consent from both parties.

4. Confidentiality
We will maintain the confidentiality of any information provided by the Client, except where disclosure is required by law or where necessary to perform our obligations under this Agreement.

5. Fees and Commissions

Buyers: Typically, our fee is covered by the seller as part of the sales commission, unless otherwise agreed upon in writing. Sellers: Our commission rate will be outlined in the listing agreement. This commission is typically a percentage of the final sale price and is payable upon the closing of the transaction.

6. Client Obligations

Accurate Information: The Client agrees to provide accurate and complete information necessary for us to perform our services. Exclusive Representation: The Client agrees to work exclusively with us for the term of the agreement unless otherwise specified in writing. Cooperation: The Client agrees to cooperate with us in a timely and professional manner.

7. Limitation of Liability
Jenny Gong Realtor will use reasonable care and skill in providing services. However, we are not liable for any indirect, incidental, special, or consequential damages arising from or in connection with our services.

8. Termination
Either party may terminate this Agreement with written notice if the other party breaches any material term of this Agreement and fails to remedy the breach within a reasonable period. Upon termination, the Client will be liable for any fees or expenses incurred up to the termination date.

9. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the state in which the property is located.

10. Dispute Resolution
Any disputes arising out of or in connection with this Agreement shall be resolved through negotiation in good faith. If a resolution cannot be reached, the parties may submit to mediation or arbitration as a final remedy.

11. Amendments
This Agreement may be amended or modified only by a written agreement signed by both parties.

12. Entire Agreement
This Agreement constitutes the entire understanding between the Client and Jenny Gong Realtor and supersedes all prior agreements, understandings, or representations, whether oral or written.
